Nnamdi Kanu, the leader of the banned Indigenous People of Biafra (IPOB), has lodged an appeal against the ruling made by Justice Binta Nyako at the Federal High Court Abuja on June 19.
He is disputing the court’s authority to hear his case.
Kanu, represented by his lead Counsel, Alloy Ejimakor, submitted a notice of appeal at the Court of Appeal in Abuja.
Ejimakor stated, “Earlier today, I filed a Notice of Appeal with the Court of Appeal in Abuja against the June 19, 2024 ruling of Justice Binta Murtala-Nyako, refusing Mazi Nnamdi Kanu’s application objecting to the jurisdiction of the Federal High Court to subject him to trial.
“The grounds of objection are seven and mainly based on provisions of the Constitution, the Terrorism Prevention and Prohibition Act 2022, and other relevant laws.”
The only respondent in the appeal is the Federal Government of Nigeria, which is expected to be served through its Counsel, Adegboyega Awomolo, SAN.
The notice of appeal stated, “TAKE NOTICE that the Appellant being dissatisfied with the Ruling of the Federal High Court, Abuja Division delivered on June 19, 2024, hereby appeals to the Court of Appeal, Abuja on the grounds set out below and will seek reliefs at the hearing of the Appeal.
One of the grounds cited is an alleged error in law where the trial judge supposedly erred in law regarding the counts of charge retained against the Defendant.
