The lawyer claims that the two-time Oscar winner has been “stonewalling” by not divulging information ahead of their scheduled child support hearing next week.
The pair, who share sons Cayden, 16, Hayes, 14, and daughter Grace, 13, have been embroiled in a bitter legal back and forth ever since Baumgartner filed for divorce on May 1 after 18 years of marriage.
Since filing to end their ill-fated union, Baumgartner was forced to vacate Costner’s plush $145 million estate after initially refusing to budge.
She was temporarily awarded $129,755 per month in child support — far lower than her original request for $248,000 a month.
The mother of three is also entitled to a $1.5 million payout under the terms of their prenup, and Costner must pay $200,000 in attorney’s fees and $100,000 in forensic costs.
“(Kevin) has requested a multi-day evidentiary hearing on (Christine’s) request for child support, at which time the Court will receive evidence regarding (Kevin’s) gross cash flow available for support and anticipated future income,” Baumgartner’s lawyer wrote, according to the outlet.
“(Kevin) has also requested a trial to determine the validity of the parties’ Premarital Agreement, the unconscionability of which will depend on an analysis of how the terms of that agreement compare to the parties’ present financial realities.”
“The Court will need to receive evidence regarding those circumstances to make its determination. However, (Christine) will be unable to present any evidence that (Kevin) has chosen to withhold from discovery,” the lawyer added.
For his part, Costner’s lawyers objected to providing the requested information, calling the filing “burdensome, oppressive, and harassing.”

“This Request seeks documents that are not relevant given the parties entered into a Premarital Agreement containing a limitation on spousal support and providing that all income earned during marriage would be the separate property of the spouse earning the income and providing for no community property,” the “McFarland, USA” star’s lawyer wrote.
It comes as Baumgartner, 49, this month claimed that she may not have understood their prenuptial agreement when they signed it in 2004.
In response, Costner’s legal team asked if the handbag designer comprehended what she signed and asked the judge to make Baumgartner’s legal team reveal whether or not their client actually understood the written contract.
